Terms of Service

1. About Us

Tradey Booking Services ("TBS", "we", "us", "our") provides an AI-powered call answering and appointment booking service for tradespeople, connecting incoming customer calls to automated call handling, calendar booking, and live transfer where needed. These Terms of Service ("Terms") govern your use of our services as a business customer ("you", "your", "Client").

By signing up for or using TBS, you agree to be bound by these Terms.

2. The Service

TBS answers incoming telephone calls on your behalf using AI voice technology, captures caller details and job information, checks and books appointments into your connected calendar, and — where a call is flagged as urgent or the caller requests it — transfers the call live to a designated real person (you, your business partner, or another number you provide).

We do not guarantee that every call will result in a successful booking or a successful live transfer. Telephone networks, third-party software, and live availability of the person receiving a transfer are outside our control.

3. Eligibility and Your Account

You must be a legitimate trade business (or acting on behalf of one) to use TBS. You are responsible for the accuracy of the information you provide us, including your business name, contact details, calendar availability, and the phone number(s) designated to receive emergency transfers.

4. Fees and Payment

Pricing is agreed individually based on your business's needs and call volume, as set out in your enquiry or agreement with us. Fees are billed monthly unless otherwise agreed. There is no long-term contract — either party may cancel with notice as set out in Section 10.

We reserve the right to change our pricing for new agreements at any time. Any price change affecting your existing agreement will be communicated to you in advance and will not apply retroactively.

5. Call Recording and Data

All calls handled through TBS are recorded and transcribed for quality assurance, dispute resolution, and service improvement purposes. By using TBS, you confirm that you have the right to have calls to your business number handled and recorded in this way, and that this complies with your own obligations to your customers under applicable law (including UK GDPR and the Privacy and Electronic Communications Regulations).

We process caller personal data (such as names, phone numbers, and addresses) solely to provide the service to you. We do not sell this data. Full details of how we handle data are set out in our Privacy Policy.

6. Emergencies — Important Limitation

TBS is not an emergency service. While our system is designed to detect urgent issues (such as burst pipes, flooding, or gas smells) and prioritise or transfer these calls, it is an automated system and may not identify every emergency correctly, and live transfer is not guaranteed to succeed on every call (for example, if the designated recipient is unreachable).

You are responsible for ensuring your customers are separately made aware, where appropriate, that in a genuine life-threatening emergency or suspected gas leak, they should contact the National Gas Emergency Service (0800 111 999) or 999 directly, and not rely solely on TBS or any tradesperson's call answering arrangement.

7. Service Availability

We aim to provide a reliable service but do not guarantee that TBS will be uninterrupted, error-free, or available at all times. We are not liable for failures caused by third-party services we rely on (including telephony providers, AI infrastructure providers, and calendar platforms), or by matters outside our reasonable control.

8. Limitation of Liability

To the fullest extent permitted by law, TBS's total liability to you for any claim arising from or relating to the service is limited to the fees you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profits, loss of business, or loss of reputation, whether arising from service errors, missed calls, missed bookings, or failed transfers.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud, or any other liability that cannot be excluded or limited under applicable law.

9. Your Responsibilities

You agree to provide accurate information about your business and services, keep your calendar and availability up to date, and respond to bookings and transferred calls in a timely manner. TBS is not responsible for outcomes resulting from inaccurate information you have provided, or your failure to act on a booking or transfer.

10. Cancellation and Termination

Either party may cancel this agreement by providing notice, as agreed at the time of signup. We may suspend or terminate the service immediately if you misuse the service, fail to pay fees due, or breach these Terms.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes. Continued use of TBS after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
